OKLAHOMA CITY — A judge has ordered a poacher to pay $33,000 in restitution for killing a tame white-tailed breeder buck, in a pen in 2008.

Justin Ray McDaniel, 25, of Newalla also was put on probation for 10 years and must spend 10 days over weekends at a private lockup. He agreed never to hunt again.

"People like you really shouldn't be hunters," Oklahoma County District Judge Jerry Bass said Wednesday.

McDaniel was sentenced for grand larceny of exotic livestock and making a false statement at a hunter check station. He pleaded guilty in November.

A prosecutor told the judge that the deer's owner and a breeder lost more than $1 million in potential breeding income. The judge said he was awarding restitution to the deer's owner for actual damages.

McDaniel told the judge he killed the buck for the ego boost.

"It's hard to explain," he said. "I did it to sound like a cool guy."

McDaniel described how he climbed over fences at the Oklahoma County deer breeding ranch at 3 a.m. and shot the buck with an arrow and dragged it to his truck. He later reported that he shot the deer in the wild in another county.

"I'm sorry," he told the deer's owner and breeder. "I know that may not mean a lot to you, but I truly am."

I can't even imagine how someone could do such a dispicable act! He should have been given more jail time, imo.

$33,000 is essentially the price of a nice car. So had he stole a car would the punishment have been the same? He stole the deer from the owner. But in this case the deer was part of the owners investment in his business and had future value as well as the purchased value. Not punishment was not enough. This is not about whether or not he was a "bad hunter," it is about stealing.

This was not the first "strike" against this guy. He had done this before while in the military. He is a piece of dog sqeeze.

Maybe not harsh enough but the toughest I have seen dealt out anywhere to my knowledge. Thanks to all involved for seeing this through to the end. A fine amount that is to great could cause a person to never be paid. If they get $33,000.00 dollars I will be happy for them. The loss of hunting privileges for life in Oklahoma also means the loss of hunting in all states that are on the reciprocal list, which is extensive. It should serve as a stern warning. I had hoped for a year in prison served on weekends to make sure he can hold a job to pay restitution. That woulda given him 3 and 1/2 years behind bars on weekends.

Shoulda shot him in the leg with an arrow! A good limp might help him remember it better than a judgement he'll probably try to wiggle out of!!! Michael........DOG SQEEZE he is!

I'm with Tim. Any restitution at all is good for us all. Maybe this will set the standard for the future. This willl make poeple think before they do it again.


BTW Anybody heard what ever happed with the "PeaBody" case?

I'm am very pleased with the outcome it may not have been the best but its a start. I agree with Roger if he had stole a car he would have received 5 years if he wasn't a first time offender and he had a good lawyer. Now from the Defiance Mo. side of me. I like to watch a little reality tv. So how about anytime a crime is committed against a person we set up some kind of cage match. Just image putting this idiot in a cage with Mike Tyson no referee, no bells and the time limit set by the victim. All on pay per view in witch the victim receives all the money. After he comes out of that with several knots on his fore head, Teeth marks in his ear and a sore hiney (from Mikes prison days) he'll think twice next time.

Pea Body was , I thought, a buck owned by John Shade in Florida that was shot too.
